My wife is on AP valid until March '05. She needs to leave the country until May '05 to finish her last year of undergraduation in India. After talking to my lawyer, she mentioned it is not advisable to leave the country for so long. My questions are:
1. To apply for AP, does the person applying need to be physically present inside the country?
2. If she leaves now, will she have a problem coming back after a stay of > 6 months outside the country?
Has anyone else been in this situation?
