I have an I-485 pending originally filed for an approved EB2-NIW I-140. Also I have an approved EB1-OR I-140. Several months ago I mailed to ask NSC interfile my I-485 to follow EB1 I-140, but, as usual, no written confirmation to my request.
Since my I-485 has been pending for more than 6 months, could I use AC21 while still keeps the I-485 with the EB1 I-140? EB1 is preferred for me because of the retrogression.
