Hi Friends,
I some confusion about the H4 status and pending 485 application. Please let me know your views on this.
1. 485 applied for my wife on Jan 2004, but not using EAD or anything.
2. My wife’s H4 got expired on March 2004 and even the I94 at the same time.
3. She left to India in May 2004.
4. Returned from India in August 2004 with Advance parole, now the I94 is Valid till October 2005.
Question.
1. She is still in status right ? She is under Adjust of Status (AOS) status right.
2. After October 2005, how to extend your I94, or do we have to do anything.
My H1 was applied on October 2004 and still waiting for the result. We did not apply for H4 extension since we were waiting for H1 to get approved and apply for her extension.
