Question on 140+485 ?

My husband and I want to apply NIW separately ( 140+ 485 together). In my case, he is a dependent. At his case, I am his family member. If we both apply NIW(140+485), we both have two 485. Is this ok?

Another question : If we apply NIW now, then apply H1( current F1-OPT) a few months later, is there any bad effect on our H1B application? :

I am in a reasonable close situation with my wife as you are with your husband. We both are in the process of applying for GC. (BTW since you are married to him you are in his case also a dependent). Our lawyers adviced us that we both can have I140 pending at the same time but only one I485 (you can have in theory more than one I-485 but there is a high chance that they will "invalided" each other. So nobody is doing it.). You should both apply for GC but only one should do it concurrent (the one who has a greater chance of success). Sorry, can't help with the F1-OPT.

I filed NIW first when I was on F1/OPT, and I applied for H1B later. I got H1B approved within 15 days.

No, I filed I-140 only first 5/2004, applied H-1B 7/2004. I filed I-485 3/2005 when my I-140 was still pending. Hope this helps.

You CAN NOT have 2 485s. You will hurt yourself by doing that. Peroid.

---I think what you are saying in your post is you are currently in F1/OPT status, and you would like to file NIW now and later on apply for H1.
If above is the case, then it won't hurt filing H1 later. Make sure that you will be in status when you file your H1, meaning should be in F1.

So my husband will file 140+ 485 and I will apply 140 only. Then we will apply our H1B later (during OPT).
