question marriage related....

My spouse is a non citizen who does not have a green card. He did not come here with a visa or anything...

We have not contacted a lawyer yet, but I am wondering to get him a green card will he have to leave the usa and go back to his country before they will grant it to him?

What is the process? I'm very clueless when it comes to the whole immigration process and green cards.....

He won't be given a green card since he came into the country without inspection. How long has he been in the country? He is subject to a 10 year bar if he is here illegally for 1 year or more.
 
While the future does look bleak (someone who has EWI- entered without inspection) can not adjust status within the US, a waiver can be filed and assessed at the embassy in your spouse's country in order to over come the lifetime ban.

I have no experience in these waivers, but theres an excellent forum that deals exactly with them...they even have sub forums that detail the questions and experiences from the different countries the spouses are from. The forums you would be looking at are the I-601 waivers forums.

Just because he doesn't have a visa doesn't mean he was not inspected. Lots of us cross the border legally with no actual visa (when most think of visa they think of paperwork and a card and what not), just inspection.

The difference is if he entered illegally, or not.
