Hi United Nations,

I got an education RFE (3 yr BSc Electronics + 1.5 yr diploma NIIT) applied under EB2. That should normally call for a denial but I got an RFE stating that the equivalency submitted was "functional" which was good for the H1B but not for the GC. The lawyer submitted the evaluation which was done for my H1B.
They asked for more evidence (don't know to prove what).

This was on June 16. On Aug 12 lawyer responded with an evaluation done by TrustForte this time and an appeal to reclassify the petition to EB3. There was change of LUD's from 12th Aug to 17th almost every day bar Sunday, Sat. and then silence.

I have no idea what is on the 750A.

Any ideas on what my situation would be.

This waiting is killing.

Hi UN,

There is some hope after I read goodluck's post. My lawyer seems confident (dont they always) that the second evaluation plus reclassification request should pull me thru (pls note that they did not suggest a reclassification, we are asking for it). One positive note (clutching at straws) is that on 19th august my EAD was renewed for 1 year and on 23rd august they issued my first FP notice. Pls note that these are after 12th august when RFE response was rcvd. The earlier eval was done by some vague educational service.

If it will be of any help I can put in the exact statement in RFE.

And also thanks for taking the time and effort to reply. You are doing a yoeman's service.

When I see some you guys staying positive despite all, it gives all of us much hope. Sometimes we have to pay a price for the incompetence of others.

My education details are B.sc and 3 years of NIIT.
Don't know about the details about Labour.
Filed for GC in Jan,04, till this date no updates.
