Hey,

I got LPR status being married to my US Citizen wife. My Resident status started on 03-20-2007. Am I able to apply 2yrs and 9mths after my resident date of 03-20-2007? That would mean I could send the application 12-01-2009 right?

You can apply 90 days before the 3rd anniversary of your GC. In your case, 90 days before March 20, 2010. Note that it's 90 days, NOT 3 months. Count the days carefully. If your application arrives even 1 day early it will be rejected and you will have to apply again and pay another fee.

Also, it is risky to try to time it down to the exact day. Even if you count the 90 days exactly right, they may count it wrong by a day or two, and erroneously reject the application. And that rejection may happen months after you sent it in, because they don't immediately open and analyze every application as soon as it arrives. At that point, even if you can get them to admit they were wrong, although you can reapply you can't get back those wasted months. So aim for something like 85 or 86 days prior to the 3 year mark to avoid that problem.
