Can a person have 2 140/485 apps pending?
Here is my situation.
1. I received my first EB2 RIR approval OCt'02 through Employer A, and 140/485 filed simultaneously, received 140 approval. Had to quit. Emp A continues to process. It's been over 6 months.
2. Employer B filed PERM EB2-RIR and I received approval in less than 1 month. Now they are getting ready to file 140 this week and cannot file 485 since I am from retrogressed country.
Am I allowed to have 2 apps simultaneously. Employer B is using my current A# in my new filing. Do I have to request retaining my old PD after new 140 approval?
