I have a question for you which I tried asking in a pvt. message but it appears your inbox has exceeded the total limit allowed (the msg. states that you may have clear it by deleting some messages). Is there another way to contact you?

another question for gurus

I had a quick question. if a person files I140 and suddenly the visa dates become current (in our dreams !!) ..can we file for 485 ..or does he have to wait till the I140 is approved. please reply ..it is urgent ..Thanks
 
Concurrent I-485 with I-140 is still allowed, so once your priority date is current you don't have to wait for the I-140 approval to file the I-485.

As per current regulation, the person doesn't need to wait till I-140 is approved. (S)he can file it as soon as date becomes current. They don't approve change of status if 140 is denied.

They are talking about changing this very soon as this creates lot of legal complications and confusion.

what about H-1 extension. my 7 yr expires in Jan 08. say I file I-140 regular (company is dragging on premium) ...I140 takes more than 12 months ..will I be able to apply for H-1 extension ? if yes, based on what (since labor is no longer pending and I 140 is not approved) ..Thanks again.
I will be asking my lawyer too ..but she used to charge for everything :)

You are still eligible for 1 year extension. If 140 is approved, you are eligible for 3 years of extension.
 
One can get 1 year H1 extension

One can get 1 year H1 extension if I-140 is pending and PD is at least 365 days old.
