sorry guys!! I did replied of Mr. Nogc for 6 years message at two places, but was not knowing this
Anyway, immediately after your message posting on sept. 5, I called NVC and they still have same record playing... "packet 3 sent to the attorney..file papers at US consulate, Mumbai..etc."
Here is my views:
If I-140 is approved for CP, then VSC transfers file to NVC. NVC sends out Packet-3 to lawyer/individual once priority date is current. Upon getting confirmation from lawyer/individual about their intention to file at US consulate of Home country, NVC will transfer file to US Consulate of Home country. This is how it is working (per my lawyer).
But, in my case when I spoke to rep. at NVC, he said file is transfered to Mumbai. So, it is very likelyhood that NVC had transfered file to Mumbai without waiting for confirmation from our side as my priorty date was currrent when my I-140 got approved. My lawyer never received packet-3 and filed I-485 at VSC (AOS).
I learnt from these discussion forum that file is not getting physically transfered but via cable. So, when I filed my I-485, they (VSC) might have initiated action to get file back to VSC from Mumbai. It seems that I was lucky enough that my file was back when they started adjudication of my application. There are chances that I-485 get delayed if I-140 file is not available with them at the time of adjudication.
