Question for I140 Redoers ?

i checked the AVM message for my I140 Redo and it says
"it\'s taking between 240 and 480 days", is this message normal for I140 redo? it seems the same as I140.

Did my lawyer screwed up somewhere in my application, I checked the application that she sent, and the Alien # is mentioned there and it’s says there that this is a response for I485 RFE.

So what is going on there. Does any body know?

Atleast your 485 message says that they have received your response to RFE, mine doesn\'t even say that. and my 140 redo has been approved on the 4th DEC (yes december) and the avm still says we have received blah blah!! and no sign of anything yet.

Yes. All I-140 petitions have the same message. The only thing that you can do right now is to check to see if your I-140 (redo) receipt has your A# printed on it. If it is, CHANCES ARE that your petition has been considered as a redo and that it will be expedited. But if you do not see your A# on the receipt, you chances are that it has been considered as a fresh I-140 and will NOT be expedited. Your employer of you will have to do the following up and make them swithch the petition from FRESH to AMENDED. And amended I-140 petition is approved in 1 to 6 weeks (normally!!!!) ....

I recd my recipt for I-140 redo and there is no provision for a A#. It just has columns for Reciept # I.e EAC , Case Type I140 Reciept date , Petiotioner Notice date and beneficiary. Ther is no A# on that. Only my 485 recipet notice has a A#. How do u guys have a A# on the I-140 recipt notice. Kindly confirm if I am missing anything.

The I-485 A# should technically appear just above or below your (beneficiery) name on the I-140 (redo) receipt. If it is not there, then it would appear that your I-140 petition is being considered as a FRESH one and not an amended one. In which case, I would think it prudent to call the INS up and try to confirm that it is being expedited, and if not, try to explain the situation to them and get it expedited. I know of 3 cases personally (including mine) where the the INS had to be specifically told of the situation over the telephone....
    Another clue that you can examine is the time lag between applying (for your I-140 redo) and getting a receipt for the same. Generally, an amended I-140 petition is issued a receipt within 10 days and the difference between the Receipt & Notice dates is roughly 1 week. Whereas, in the case of a fresh I-140 petition, a receipt is generally issued in roughly a month and the difference between the Receipt & Notice dates is about 3 weeks....

Thanks for the reply. I checked the notice but found no A#. As regards the time lag, the recipt date is just one day after my attorney mailed the Redo package and Notice date is just 5 days after the reciept date with 2 days in betwee being Holidays for New year. So it seems like they looked at my package immediately as soon as they recieved it. Do you think I should call IIO and if so is it possible for them to link my application with my 485. Let me know ur thoughts.

Well, as far as times go, it looks like they have actually considered yours as an amended petition. It is possible that they just forgot to key in your A# when they entered your I-140 petition. If you are tracking other people who filed just like you did around the same time-frame, you may want to wait till you start seeing approvals for them. But it is still not a bad idea to call them up and try to make sure that everything is fine....

INS counts the 180 days from RD or from ND.

Please do post the info if some one knows.

Theoretically it is from the RD (according to the spirit of the law), but it likely to be interpreted as the ND. We will have to wait for the INS final regulations to be published before anyone can know for sure....
