Question for I WANTMYGCNOW ?

I have a friend who was reacently asked to submit application I-602 because INS services say that he entered the U.S. a fradulent Passport but he did not enter the country with a fradulent passport what should he do? Explain in his affidavit that he entered the U.S. with his original passport.The second question that my friend didn't properly complete Part 3 Section C of his I-485 application so INS asked him to submit in his affidavit every political organization, association, fund, foundation, party, club, society, but i section Part 3 Section C of application I-485 it say's nothing about political party or organization could it be that we are looking at the wrong part of the application and if we are could someone point that part out to me i would appreciate.

Well the law they are referring to is called "misrepresentation", Your friend entered on a real passport but maybe the Visa was obtained in fradulent way. Lets say your friend asked for the visa to visit U.S but really wanted to immigrate...In front of Immigration that is misrepresentation.

Your friend should write the truth. If its the real passport write it down and see if this was what was written in the asylum application. One of my realtives entered EW(Entry without inspection) but they wrote she came on "fake passport"....She didnt even have a passport....So tell him to explain as he did on his asylum applicatoin and also his interview...Then add that family unity reason and good member of society as areason they should give him the I-602 waiver.

The other question is very simple. Do what they say. In your asylum application see what you wrote and write an affadavit. I dont have the I-485 but download it and see what they mean...but an affadavit stating you are no part of any parties etc..will do it..

What is his Notice date?

My friends notification date is feb 2001. He did his finger print and Bio June 2005. Thank you very much for replying to my matter. Before i go i would like to know if you have any I-602 Affdavit drafts that we could get an idea of what we are doing because my friend dosent speak a lot english .

Thanks for the useful insight but i have one last question about my case i recently sent in my RFI and i got this message on my last update. I would just like to find out how long it will take me to receive my Bio.

On September 29, 2005, we received your response to our request for evidence or information. It is taking between 570 and 600 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case.

this message it just a generic message made by the INS to let us know that they received your response and that they will be back with you pretty soon instead of 600 days but most definitely you will receive a boi code 2 in few weeks after that you will receive a letter said go pick-up that G.C of yours in your mail box :) PS: only if you don't get any stupid (RFE-I-602) . by the way my wife has ND 2003 but she got that bio code3 last week so good luck :)

so, are they gonna send me the I 602 to me as well ..?? I entered the country with my real passport ( no fake ) and a tourist visa legally obtained..
Before I came here to seek asylum I had been here a couple of times on vacation.
