Question for I-140 , Silly Man and other Gurus

After getting fed up with my employer I decided to quit. He owes me salary for the last four months. I have joined a different a different consulting company but the client is same.I have joined the new employer using AC21. I have following questions :

1. Should I inform BCIS about the change of employer ?

2. My employer has agreed to pay my backlogs in bits and pieces. However can he stop paying me in case he comes to know that the end client is still the same?. If this happens can I take legal course to screw him? Although I don't intend any harm to him,unless he forces me by his actions.

Please shed some light on this issues. I want to pepare myself in case of any issues arising out of this.

Legally your employer has to pay you. You don't screw with DOL especially in a democratic state like CA.

What u gotta do is .. maintain good rel. with employer. And be tactful. Give what he is giving u.

Once u get ur GC (and hopefully thats within 1 year of ur job switch coz thats the duration u have to complain) .. then u can go to DOL office, fill out a simple form .. with proof .. that .. this is what i was promised and my salary hasn't been paid to me .. and file a complaint ..

Trust me, DOL will get ur deserved money to u fast .. and if u have GC by then .. ur employer won't be able to do anything.

But .. all that after u get GC.

Thanks for the reply. I have one more question : Since I am still working with the same end client through some other agency, can this be a reason for the former employer to with hold my money.?

Does that stupid agreement which I signed while I landed in this country hold good. I have a faint memory of reading a post which said this kind of agreement is not applicable in California.

Please clarify on this issue.
