My wife is working on EAD (I am the primary applicant on GC). She will quit work shortly as she is near her pregnancy due date.

Question: Will her claiming disability benefit from State Disability insurance affect my GC process.

Does anyone have any experience on this.

I know that disability claims for the primary applicant are an absolute no-no (dont even think about it, since this tips off the INS that you have lost your job and are now a public charge, and one of the requirements that you get approved are that you never become a public charge, you are a drain on the country rather than a contributor) I'm not sure about the spouse. Why do you need disability? dont you have insurance...

In any case, I'm not an authority on this and your best bet is an attorney. If I was U, i woudnt even think about this. disability is a benefit for permanent residents, not applicants for permanent residency
