Question for experts.Changing Job using AC21

Hi,

I am planning to change my job. Its been more than 2yrs since
I applied my I-485( July 2001 ). The new job title and description are same.

My question is...what are the documents( I-140 approvals etc ) which I need to collect from my present Attorney's office before I quit.
My concern is...the present Attorney's office or Employer may not give my Green card filing documents, if I need , after I quit.

technically, you don't own either the LC or the i140 approval notice. that is owned by your employer. your lawyer does get a courtesy copy of the i140, which they could let you have upon request. otherwise, you should request a copy of your LC and i140 from either your employer or attorney. ditto for any RFEs and your attorney's responses to them.

if you fear that your old attorney may not be cooperative, and you are planning to hire a new attorney, then have your new attorney get in touch with the old one, and get your whole file transfered. professional courtesy (or, honor among thieves?) does help out.

hiring a new attorney is helpful and recommended also if you fear any retaliatory actions from your old employer, such as any attempts to revoke your i140. while AC-21 offers protection for the i140 when one's i485 has been pending for over 180 days, BCIS adjudicators have proven to be a pretty ignorant and unpredictable bunch when it comes to AC-21 cases where the old employer/lawyer has gotten in touch with the BCIS, even if it just to inform them that you are no longer with them. search the archives, and you will find a few horror stories.

if your new employer has an immigration attorney, then just go ahead and use their services.
