dengdeng,
can you pls share your experience with markey's office.

a. how long did it take to talk to jackie lavender for the first time.
b. what was your experience with her when you tried to follow-up with her.

The reason i am asking is because so far i have not been able to talk to her. i have been trying to get in touch with her for 2-3 days now but i have never been able to get hold of her. i always get the reply that she is busy in a meeting or in a conference call. so for me it seems a non-starter.

seems like we are really out of options!!

Yoda, I called her in early morning, because I have to go to work. Call her at 9:15 will work.
I also called her once in the afternoon, she's there too. She works at Medford office Monday - Thursday, Framingham office on Friday.

Leave her a message, and she probably will call back.

She's very nice at first call. She said she would call me back once she got an update but she didn't. After a week, I'm out of patience, so I called her and she said "your case is being worked on, if in 30 days, doesn't hear anything, call me back" That certainly is not useful. And I asked her about security check stuff, she said she didn't hear anything about it from VSC. But I asked her to ask!

If you have a way to use Clueless123's congressman, that will be better. If you work in the clueless123 area, just give them your work address. That office is faster and gave more information than Jackie. She didn't tell me anything in the end.

She said she can ask for "expedite" if I didn't hear anything in 30 days, but I know it's impossible because clueless123's congreeman said can't expedite, clueless123 is Oct RD.

Yoda, something must be wrong with your case. I'm not saying you are identified as a terrorist or you were out of status anything like that, don't worry. But I think your case is somewhat "lost". Or could be "approved" but they forgot to send out the approval notice. That happened to my H-1 visa. Since you sent RFE in Jan and second Fp in May, you should be approved in mid-June. You're a Sep case. I think you should call Jackie and make an appointment to see her in person. And ask her to send expedite request directly. Yours should be qualified as "error" IMO. I definitely think it's an error of BCIS not updating your case. I put bet on it. You should ask for expedite. Don't hesitate, do something! Best wishes.

yoda, look at http://www.shihab.net/flash/vsc_exp_criteria.pdf

This is the expedite form. Jackie probably has it and can ask for it. I would say "service center error" and she will be the petitioner. She probably is saying the samething, "ask expedite your case".

Try it, may work. I know a August RD send expedite letter to VSC, write a letter to director, and get approved in a day!

Try to convince Jackie that you're Sep RD, everybody else is adjudicated, only you left, and you have done 2nd fp in May, it has been three months since. Must be an error they misplaced your file.

By the way, do you know if the center has received your 2nd fp? could be they are still waiting on it

Thanks for the info dengdeng. Let's see if and when i get hold of her.

i dont think clueless's congressman represents my office town.

One thing that i guess all of us know after reading people's experiences on this board is that you never know what might work for you. I have seen ppl getting help from senator's office and getting approved in a week. this obviously is not working for us. i have seen an august filer whose lawyer sent an expedite request a couple of weeks ago and he got approved the next day. now i can bet that it will never work for most of us.

I called 1-800 number in middle of last month. i am expecting a letter from them in a week or two. let's see what they are going to say.

and yeah, my 2nd FP was received by VSC in 3 days.

yoda, I saw somewhere on internet Service Center should grant expedite once your case is over 30 days + processing time released by center. If you case is 20 months by now, you have the reason for expedite process. You should qualify.

yoda, can you ask Jackie what's the criteria for case to be expedited and how can we request it since she mentioned the word "expedite" to me that means she has handled it before.

Thanks!

or

they might say that security check is not done based on the response that BCIS got from FBI, at least that is what happened to my case and i was told my case has been under security check for about 5 months. maybe the agent who is responsible for my case took a long maternity leave or got fired. who knows! I am starting to suspect that BCIS actually don't give a damn about congressman or senator(in most cases, senators they don't care about us), to me, BCIS seems making up better excuses to stop the pressure and interference from congressmen. :o

davli024, your senator told you about security check voluntarily? Since VSC didn't say anything
about security check on my case, I would think mine is fine, otherwise they will mention it to the congressman office. Any insight?

in my case, when senator kerry's office contacted VSC in april, they got the reply that my case was with an adjudication officer and that i'd hear something within 2 months. of course that didnt happen, though i got a 2nd FP notice within a week which for all we know might have been auto-generated.
senator's office didnt tell me anything about whether my security check had been complete or not

dengdeng

my congressman asked for my security check status voluntarily because I particularly stressed this issue when I asked for her favor. I am not very optimistic about the theory that if BCIS don't mention your security check, they actully imply that you passed it. sorry!

if the security check is the not excuse they gave to your congressman, what is it?

Just say being worked on. I guess mine is because FP expired, no FP notice received. That's the real issue.

i totally agree with davli024
if a senator's response doesnt tell you anything about security check, it does not mean that you security check is done. it just means that VSC didnt choose to tell them about security check. i also agree with the point that generally these days BCIS doesnt care much about a congressional inquiry. but like i said earlier, you never know what might work.

dengdeng, my RFE was about medical. my doctor had not filled the form correctly.

What can I do then. I asked the congressman office to ask about the security check and they didn't. :(

Plus I called VSC in May, asking about the check, one officer say don't know, one officer said seems okay.
