My EB3 PD is Oct 98. Im sure that there are a lot of EB3 folks out there like myself who filed their 485 when the dates became current in 99-00 and for whom the dates are not current now. The recently passed H1B regulation allows for persons who have waited for 180 days or more for their 485 approval are allowed to change companies retaining their Labour and I140 from the previous company. But what happens to the 485 application? Does it have to be refiled? If so this provision is useless for folks such as myself because the EB3 PD is unlikely to become current for us anytime soon! Any information would be appreciated!
