Question - Anyone else in this situation?

Just spoke with an IIO who was extremely nice and helpful.

The IIO mentioned that although the processing officer has my I-485 file, he/she is waiting to receive the I-140 approval before he/she can act further on the case. I am not sure where the I-140 approval will come from (probably the National Visa Center).

She also mentioned that there is no way of knowing more about the case status or when the I-140 might be received by the adjucating officer.

Has anyone else been in this situation? Do you guys have any idea about this and normally what is the processing time for this situation?

Any information will be very helpful.

Thanks.

This might be new

After they started simultaneous processing of I-485 and I-140, they might have added a new step to get the I-140 before they go ahead and approve the case. Gosh - I hope they realize that all cases before a particular day went through I-140 before going for I-485.

I *think* when they approve I-140, the file goes to National Visa Center (NVC). If it's for CP, then NVC will notify and forward the file to the consulate of home country. If it's for AOS, then the file will stay at NVC until requested by a Service Center for I-485 adjudication. There are cases where I-140 was (mistakenly)approved and tagged as CP while the applicants already live in the US. This could add the delay as the file has to be requested back from the consulate abroad.
Such a mess....

I think you're right. They did mention something to the effect of NVC process. My I-140 was originally processed for consular processing and then changed to AOS. Not sure if this is what might be causing the delay.

Thanks for your input.
