Question about RFE (for birth certificate)

Hi all,

I filed for AoS based on marriage to a USC mid-October and just received EAD/AP approval today. The next step in the process, from what I understand, is the interview.

My question is about possible RFEs between now and the interview. How late into this process could an RFE show up? In particular, I was half-expecting an RFE regarding my birth certificate because I didn't have the original (my birth was never registered in 1973), but so far I haven't received an RFE for it.

In the AoS application, I ended up using a BC from the Indian consulate, which says clearly that it's based on the information in my passport. FWIW, I am preparing myself for the possibility of an RFE: I am now getting affidavits from my parents and an aunt attesting to my birth. But I am having trouble getting a non-availability certificate because the folks at the local municipal office are giving my 73-year old dad the run around!

So I suppose my question is this: what are the odds of receiving an RFE for my BC, if I haven't already received one?

Thanks everyone!

doneleftaustin,

I got my gc about 5 years ago using the bc issued by indian embassy. The friend who advised me to do so also got the gc using the bc issued by consulate. Based on various cases that I have seen with my other friends, the chances of getting an RFE are slim.

thnx
