Question about rejected B1 in chennai(I know it is wrong forum but please reply)

I know i am posting in 485 forum, i am sorry but i really need advise on this. I also posted on the B visa forum too. I am hoping to see some insights.

My mom's visa got rejected yesterday and needless to say we are so unhappy. I sent an invitation letter and all the other documents . She is a widow and my 2 brothers live in India. One is married and the other is still studying (he is 19 years old). I am her only daughter and married. I work here and have a green card. they asked her questions like

How many children do you have?
Who will pay for your expenses?
What do your sons do?
What does your daughter do in US etc.

She was using a hindi translater. He went in spoke to the counsler for a long time and came back and said they cannot give her a visa. The section is 214(b). I really do not know where to go from here? what are the chances of her getting a visa if she goes again. Please reply.

You can try again. Ask her to go better prepared, and take different translator. Try to show that she's got permenant ties to India (property would help). I know cases where the visa was rejected the first time, but approved later.

You may get some insight on 214(b) and re-trying for it. Good luck.
 
Send her a notarized affidavit of support (I think form I-130) and ask her to carry that to the consulate. If possible mention your total household income on the form to make a stronger case. Also, send her a letter addressed to the Visa officer requesting to grant her a visa to travel to US.

She should go better prepared this time because if they reject a second time, then she won't be able to apply for a few years(Don't remember the exact time period)
 
I know a person who applied 10 times and got approval, all within a period of 2 years. My mom's visa was denied twice in my home-country but she got it when she applied in Canada. Once denied, it is better to wait for 6-months to reapply. Affidavit may help but the bottom line is she has to convince the councellar that "she is NOT going to stay in US".

The samething was happened one month back to my parents. They have used Telugu translator and she asked so many questions and conveys everything to officer. They rejected on ist week OCT.

Again I took an appointment this Nov 3rd week and they got Visa day before yesterday. So she(ur MOM) can attend as many times as she want and there should be only 3 days gap. (Note: do not need to wait long time, she may attend next week if she wants).

Second time my parents submitted same documents and waited for Telugu translator. But she (Telugu trans) is taking much time to interview the persons and my father know little bit english and he requested to attend in second counter where American officer is taking Interviews. He asked same questions and my father explained little bit and he satisfied and issued visa.

only they provided extra document is COVERING LETTER. This will help to your mother to get visa. In covering letter she may write everything that her relations within INDIA para by para....and let her keep this letter infront of all documents. I am very sure Visa officer will consider this and will issue visa.

Also let her provide more assets documents and photos with family members (atleast 4 to 5 with your brothers and her grand children, with all family if possible). I know this is not required, but they will consider this is an extra document. You know they only required the good documentation rather than explained them.

I am sure if your mother goes all with these documents, she will get it. Last month I was in same situ like u, I don't have any hopes.

But by GOD's grace my parents got it. If your mother knows little english that is fine and she can take an appointment in English only. That way we can avoid these hassles(translators).

Have you send notarized affidavit of support? Same thing happened to mother and father. My mother and father didn't have the affidavit of support and they were denied the B1 visa. Second time they went with the affidavit and they got approved. Just for Info. - My father was fluent in english

Also explore the clause 245(b). It has some meaning. Even my father and mother passport was stamped with some clause. I asked the US consulate in India to clarify what it meant.

Explore the possibility of sending your brother along with your mother. So that he can answer the tricky questions.

Also remember when you take second time appointment you will get the refund for the appointment fee you paid eaarlier if you show your earlier appointment letter to the consulate.
 
We had the same problem.
My Mom's visa got rejected twice one in July and she went again on Nov 8th.
We had all the documensts in order. I had notarized affidavit of support letter to consulate and everything. She genuine has sufficient funds in India(although I mentioned that i am supporting). I have a brother and sister in India.
No luck. second time she was quizzed for 2 hours but no luck. The only reason they are giving is since my Dad is passed away she is potential immigrant..

I am very frustrated. These morons at the consulate might have given visa to Bin Laden or his parents but do this stupid scrutiny on us

I want to try out to contact the congress man. Did any body know of contacting the congress man.

My father passed away too but a long time back when we were kids. I have no idea as to what to do. We tried making another appointment and it is only available in late feb.
 
Sorry, but I don't think congressmen have any control over the consulates abroad. I may be wrong, but I don't know anyone who has tried or done this.

you didn't mention whether you mom is employed or not. If employed, she can justify that she has responsibilities back in India to take care. I guess she doesn't work, otherwise you would have mentioned it.

She can tell the interviewer that she has a 19 year old son who is still studying, not yet settled in his life. She has a big responsibility to take care of him, to assist him until he is in a position to take up a job.

As long as she has some responsibilities back in India and explained clearly during the interview process, there should not be any problem second time.

You may be right. I was told by my freind that his friend tried and they actually write a letter to consulate in India.
I also read it on Path2usa site. But..I never heard first hand so was checking.

This whole Visa appointment is a big scam.
These brokers at TTS services actually book all the dates on dummy passport numbers and details and you somehow get hold of these brokers who openly take money to give the date you want.(I dealt with one I know for sure)

In Delhi, my freind even found these suckers out side the consulate actually vending the dates as if they are vending peanuts or kharmure.

I spoke with my mom last night. They did not look at even at a single document, not even ds-156 form . Just asked her a few qestions and rejected her. This is so unfair. I still can't understand how anybody can come to a conclusion without finding out more.

This is exactly what happened to my mom first time they did not see anything and it felt as if they had already decided not to give. SOme said because of the elections they did that..
but second time they asked her a lot of questions and gave her the exactly same reply and exact same letter why they rejected.

I was so furious i wanted to call the consulate right then and ask for a valid explanation but calmed down.
I had emotional reason why we wanted her to be here.
