Filing AOS for immigrant spouse through marriage with a USC.
USC spouse has not filed taxes for the past 3 years, only filed 1 year (she was a dependent). And income does not cover 125% of poverty needed by I-864.
1) US Citizen spouse files I-864.
Joint sponsor will be USC spouse's parents. The parents will not be living with the couple in the future, although they are currently living in the same address until immigrant spouse gets EAD. Do the joint sponsors file I-864 or I-864A?
