Hi everyone,
I have a question about I 864. My husband is a USC and he is filling form I 864. His income is not sufficient to support me, so we decide to use our joint saving account and checking account as asset. Our accounts were opened a few months ago, so do you think that we will be able to use them to file the form? If we can, what documents do we need to send to prove the asset? I also have a saving account oversea. If I use it, does the amount need to be 3 times or 5 times the difference between the required amount and my husband's income? Can we use both our savings and my savings oversea to file the form?
We will strongly appreciate your help.

Hi miss_autumn123,
The Affidavit of Support is used to show USCIS that the immigrant has adequate means of financial support throughout his or her status as a permanent resident and will not become a public charge. The sponsor must file an Affidavit of Support Form I864 even if he or she does not have adequate means to support the immigrant. In this case, the sponsor must also find an additional sponsor to support the immigrant. This additional sponsor could be a member of the sponsor's household, another family member, or anyone who is willing to take responsibility for supporting the immigrant. Affidavit of Support creates a contractual obligation between the sponsor of the immigrant and the U.S. government.

For marriage to a USC the ratio is 3:1 for your assets. You can use both his and your savings, including your overseas savings.

For proof, make sure to provide a few months bank statements. In the interview they may inquire further about the source of the money (they are a bit suspicious of large amounts that were deposited as "gifts"), particularly the overseas account. So if your overseas savings is from selling a house, selling a car, savings accumulated from your job etc. carry documents to show that your house/car/job enabled you to accumulate that money legitimately and that it wasn't borrowed (but don't send those extra docs with the I-864 ... bring them to the interview to show only if necessary).
