Question about I-130/I485 ?

Sorry for the repost, wasn't sure if the first post was in the right thread.

Here is the situation.Spouse of (USC)
I-130/I-485/I765 was applied concurrently in April 2004.
Recieved all receipt and also had fingerprinting for I-485/I765.( already expired now).
Received I-765 after 8 months this January.

No RFE or address changed during the process.

A couple of day back after writing to Lee's Summit to inquire about I-485 a letter was received stating I-130 was approved and the benficiary is eligible to apply for I-485.????

This doesn't make sense because I-485 and I-130 is adjudicated concurrently for spouse of USC during the interview. Also I haven't seen anyone receiving just I-130 approval while I-130/i-485 was filed concurrently.

Since I-485 was applied with I-130 why would the letter state that beneficiary is eligible to apply for I-475?

Customer service or DO cannot give any information regarding I-485 status. Onlie status remains the same as pending I-485 application.

What can be done and what are the options?

Any help will be greatly appreciated

If you have a lawyer i think you should contact them and get them to assist you with this. If not this maybe a good time to get one for a consultation. IMHO.
 
Get an appointment and talk to them. Make sure you get something in writing that you asked them about your case. Maybe your case is lost somewhere and they may come back and say your case is denied because you did not reply in time while actually you never got any reply from them.

Hi ZoomZ00m,
Thats a standard message for the I-130 for all types of cases. It has no correlation with the fact that you already filed your I-485. I assume your GC is already approved? So why worry about all this? :)

My GC was approved already.
I was asking the question for a friend of mine. It seems that there is so much discrepencies in GC processing among DO's.
I was wondering since I did not get any approval letter for I-30, just the interview letter, and also because of the fact that I thought I-485/I-130 is adjucated simultaneously ( atleast in my case and for a lot of people here in this forum). The letter he got mentions that he is eligible to apply for I-485 while he actually filed it together with the I-485 caused the confusion.
Does anyone know if there are any forms that can be sent in conjunction with the letter of inquiry.
Another question was since he applied last year April (it was filed at MSC I think), is there a way of knowing where the I-485 file would be?
If the file can be tracked then they could proceed from there
Any comments/suggestion will be appreciated.
