Subject : Does I 129 petition expire if employee does not appear for VISA interview appointment after 1 year of obtaining I 129's approval.
Thanks for taking time out to read my post.
My employer applied an I 129 petition on my behalf, and the petition was appproved with a start date of Oct 2006. I have the I 797B form with me stating the start and expiration dates of the I 129 application, ie 3 years from the start of the employment.
I have not been able to go for the VISA interview at the american consulate as I postponed my start date by an year with my employer due to health reasons.
I am under the impression that I can go for a VISA interview anytime before the the stated expiration date on the I 129 application (ie 3 years from the previously intended start date). Is my understanding correct ?.
