Question about former J2 re-entry to US

Hello, everyone,

I have a question about former J2 re-entry to US. I had J1 visa and subject to 2 yrs HHR. My wife (J2, subject to 2 yrs HHR too ) stayed with me for eight months in US, then went back to homeland last month. Lately I will get the J1 waiver through the path of No-Objection and change visa status from J1 to H1 soon. So will she have to fulfill her 2 yrs HHR at homeland in order to get her new H4 visa to US? I don’t know that if I get my J1 waived, she'll be automatically waived even when she is outside US at then.

If you get your J-1 HRR waived, then her HRR is waived as well. She will not have to fulfill 2 years before getting her H4. It doesn't matter that she is outside the US when the state department issues its recommendation.
