Question about Experience Letter

Hi Friends,

I have an interesting question regarding Experience Letter enclosed along with I-140 application.

I worked from October 1997 - August 2000 for Company 'A' in India. They had a company 'B' office in NJ with different name. They have sent me on H1 visa ( Visa is on Company B) in October 1999. During that time my job is still there in Company 'A' also. I used to get base salary also. But in August 2000 when i resigned to Company B i also submitted resignation to Company 'A' which is the parent company of Company B. I got the experience letters from both the companies.

In Company A experience letter they mentioned that i worked from October 1997 - August 2000

In Company B experience letter they mentioned that i worked from October 1999 - August 2000.

But when i filed my labour i have given that i worked for Company A from October 1997 - October 1999 and Company B from October 1999 - August 2000 thinking i cannot say that i worked for both the companies at same time.

Recently when i filed my I-140 Attorney suggest not to enclose copy of Company A experience letter because its overlapping with Company B experience. So i have enclosed only affidavit of Experience letter from a colleague from that company. But for Company B i have enclosed copy of experience letter.

Now my question is there any chance of me getting an RFE for I-140 because i didn't enclose experience letter but only affidavit for Company A.

What should i do to answer the RFE if at all i get it???

Please help me out on this issue immediately

If the Experience Letter which you obtained from your co-worker doesn't overlap (which I presume), you should be okay.

In essence, you worked for Company A (October 1997 - October 1999) for which you have exp. letter from your co-worker and Company B (October 1999 - August 2000) for which you have experience letter issued by Company B.

You are covered. Don't worry about it. You are fine.
