Hello everyone.
I am a born citizen of the United States. My Fiance is a Korean Citizen who was over here initially on a student Visa, which is nearing expiration. I have been with her for a long time, in total, and will be marrying her. My problem is, we were not realizing her Visa was expiring so soon, but she does have an Employment Authorization card (says form i-766 on back of card) that does not expire for another year.
My question is, does this card give her authorization to remain in the United States, even though her original student Visa will be expiring? I was under the impression it would, since if you are authorized to work here, you would kinda have to be allowed to live here too? I may be wrong though. I just wanted to ask someone who may know better; any links to an "official" document saying one way or the other would be appreciated, but any feedback I am sincerely grateful for.
Hope you all have a great day,
