Question about EB1-EA RFE

Hi Gurus,

I recently submitted P3 to NVC (St. Louis) based on I-140 approval (NIW category). Now I got RFE for my other I-140 petition (EB1-EA category). Am I expected to withdraw the EB1-EA category petition soon? If I do not, will that be a black mark on my record? I am certainly not interested in overloading the system but I am wondering whether a future retrogression of EB2 priority dates might affect me. Since the I-140 processing took about a year at TSC I am trying to be cautious about a decision regarding withdrawal/ abandonment of the EB1-EA petition. Hoping for CP at Chennai through the NIW approval. Thanks.

At this point, the NVC doesn\'t know a thing about your EB-1 petition. Each is treated separately. Anyways, an RFE is not a blackmark. If you decide to answer the RFE (entirely your choice), you will surely have completed your CP before the TSC even opens your envelope. Brian.
