Question about e-filing I-90

Folks,
I just e-filed an I-90 to correct my non backdated GC. I checked the part that said that the card was issued due to USCIS error.

In the end, I did not have to pay the $185 but still had to pay $70 for biometric.

Here are my questions:
1. How come they don't bother to ask me to 'specify' what USCIS error it is. When will this come up? I was ready to explain the INA Act 209 that mentioned the backdating but nowhere in the e-filing process did it ever come up. I believe, if you file paper I-90, there is also NO section to mention the 'reason of USCIS error'. If they don't ask, then they will NOT know WHAT to correct. How can I communicate to them that it is the 'Resident Since Date' that needs to be fixed?

2. I got the receipt number and also the confirmation page that mentioned that if I find it necessary to contact BCIS in writing, I should write to an address mentioned on the page (address is National Benefit Center in Lee's Summit, MO). Should I just write them and explain the rules of backdating by referring to INA Act 209?

3. Since I just got my non backdated GC recently (and my bio was last April), is it possible that they won't require me to do the bio again? And if so, will they refund the $70? Or is this wishful thinking?

Could someone who has gone through this or has more knowledge about this shed some light on it?

Did your letter not tell you that they will be sending you a Biometric appointment letter. My spouses did. The letter also states that you will bring any evidence with you when you go to the local ASC for Biometrics. This is when you have to prove the error was theirs. It also states clearly on the application that you present your evidence when you go to the local ASC.

And yes we have to do the damn Biometrics all over again even though we already did this in May. And no they don't refund anything.
I think it's totally ridiculous any of us have to pay anything when they are the ones who screw up the card in the first place.
 
I am going tomorrow

I am going tomorrow to provide bio to correct my non-backdated GC (I was approved in March). I didn't pay anything for I-90 filing but have a question regarding $70 fee that you mentioned for bio. When do you have to pay $70 for bio? I already scheduled the appointment online without paying anything. Do you pay onsite?

I paid the $70 when I filed the I-90 online (e-filing) via USCIS website using my credit card.

How did you file your I-90? When you said that 'you are going tomorrow', did that mean that you e-filed before and got the bio notice? Or did you just schedule like an Infopass appointment and you are gonna go tomorrow? Please clarify.

I filed I-90 online

I filed I-90 online and I didn't have to pay anything at the time because I selected the option that said that GC was produced with errors (I don't remember exactly what were the options). After few days I received a letter from USCIS confirming the I-90 application and instructing me to schedule an Infopass appointment for bio so I did and have an appointment for tomorrow.

I think Alex filed i-90 before June. The system then changed. When I filed in later June, it asked me to pay $70 bio fee although no app fee $185. It seemed it would not allow me go to next step without pay so I paid.
After filing, I got an instant e-receipt. A few days later, I mailed evidence to the address mentioned on the e-receipt (Lee's Summit, MO). The material included printed out e-receipt, INA Act 209, copy of new GC and a brief note to explain the reason or error. Last week (after 6 weeks of dead silence), I received a notice for Bio Code 3 which is scheduled on 9/28. Code 3? FP for all Fs plus picture and signature? That is it so far.

I don't know the official description but they took my picture, signature and only one fingerprint.

Also, before going to ASC (Application Support Center, not USCIS) I made an Infopass appointment with USCIS and went for it (the same place where I went right after being approved). They told me that they do only initially approved cases and that for I-90 and GC replacements I should have made an appointment by phone with ASC (which is actually what my I-90 notice said but I incorrectly assumed I could use Infopass). So I went to the ASC the same day and they did my bio 2 on the spot (Miami/Davie ASC) within 5 minutes of my arrival without appointment.

One interesting thing though, when I wrongfully went to USCIS they checked my information in computer system and even though I was issued non-backdated GC, the system was showing my Resident Since status as of one year backdated.

Everyone's info seems to be different. I guess it depends when you filed. Ours said to wait until they sent you a notice to get Biometrics done. Nothing about making infopass appointments, nothing about phoning anyone.
They also do not ask you to mail anything. It does state you will bring your evidence with you when they schedule you an appointment.
We paid the 70 dollar Biometric fee up front. Without it they would NOT process your application. We did ours in July.
And code 2 is just a index fingerprint, signature and photo.

does they know what you are talking about ..i mean about backdated thing..?
cuz most these ppl donnt know this rule..!

In a letter that I received they required me to send the incorrect GC, they said it must be recovered before new one is isssued so I sent it back withe the letter I got fromthem and a stamp on it that bio was done. That is all. IN my wife's letter they didn't ask for her GC so she only sent back the letter she received with the stamp that bio was done.

Yesterday, I mailed a letter that explained about the backdating and I included a copy of GC, a copy of the e-filing confirmation notice, and a copy of INA Act 209 with section (b) (5) highlighted - per your suggestion.

I sent it certified mail with return receipt to the PO Box in Lee's Summit, MO.

So, in your case - after about 6 weeks, you got the bio notice? When I looked at USCIS website for my receipt number, it exists under National Benefit Center, but the National Benefits Center has no processing date information for I-90. Other service centers, however, have processing date for I-90. So, how do I know which SC processes my I-90?

I sent the materials in a plain letter to Lee's Summit, MO. It was one week after filing. I do not know if it helps. But I think atleast it wont hurt anything. It might help if it is a long process. It indeed took 6 weeks to receive bio notice. It is the only response I got since filing. The online status has never showed any change.

I also have a copy of all the documents I mailed. I am sure they will ask me to submitt along with the surrender of my GC.

Somebody explained all the codes of biometrix. I think it makes sense on why they asked me to do code3 this time. Our last full PR was about may/july 2004. It was over 12 months. W did code2 in march though.

This time, I do not really care about how long it takes to have a new GC as long as I have one. Just forget it and let USCIS take time.

Received corrected Green Card

I've received a corrected (backdated) Green Card today, about 2 weeks after doing Code 2 BIO. My wife received it some 3 days after doing Code 2 BIO (we did it together the same day)
