I just e-filed an I-90 to correct my non backdated GC. I checked the part that said that the card was issued due to USCIS error.
In the end, I did not have to pay the $185 but still had to pay $70 for biometric.
Here are my questions:
1. How come they don't bother to ask me to 'specify' what USCIS error it is. When will this come up? I was ready to explain the INA Act 209 that mentioned the backdating but nowhere in the e-filing process did it ever come up. I believe, if you file paper I-90, there is also NO section to mention the 'reason of USCIS error'. If they don't ask, then they will NOT know WHAT to correct. How can I communicate to them that it is the 'Resident Since Date' that needs to be fixed?
2. I got the receipt number and also the confirmation page that mentioned that if I find it necessary to contact BCIS in writing, I should write to an address mentioned on the page (address is National Benefit Center in Lee's Summit, MO). Should I just write them and explain the rules of backdating by referring to INA Act 209?
3. Since I just got my non backdated GC recently (and my bio was last April), is it possible that they won't require me to do the bio again? And if so, will they refund the $70? Or is this wishful thinking?
Could someone who has gone through this or has more knowledge about this shed some light on it?
