Hello everyone,
I am switching my job from a cap-exempt employer (university) in Texas to another cap-exempt university position in CA. I have a Ph. D degree from US and adequately qualified for the research position. However, USCIS issued a RFE on the H1B petition from my new employer I had two previous H1B petitions approved and H1B visa stamped in India without any problems. My current H1B status is valid till 2012
I do not know yet what the RFE is about! My new employer says I will be able to legally start working even when they are working to resolve the RFE and it should not be a problem to start before it is approved (or denied?). Is this normal or should I want until the petition is approved? Will be able to travel if before getting the approval?
