Question About Changing Job

Hi Gurus,

I am currently on EAD, working for the company who filed my I140/485. My H1 expired last year. My 140 is approved, and i crossed 180 days period after filing 485. If i want to change the Job with a different company what all i need to do(i have some questions):

1. Can i be on bench without a Job if the new Job takes a while to start. If yes means how long can i be like that?

2. When i need to send AC21, as soon as i join the job with the new company or any time after joining the new company?

3. I was seeing in the forum that the Job title and duties should be same with the new Job too. what does it mean. For example now i am a programmer, can i go for a Job as Analyst or i have to go only for programmer. In my labor document i was seeing that a similar Job for programmer is Systems Analyst. So can i go as a Systems Analyst?

OK ... basic things first ...
If you are close to getting your approval and if you can manage to stay in the current job, then do so.
Your new job has to be in the same or similar classification - make sure job responsibilities and job titles don't vary widely.

You don't need to actively send AC21 letter -- if you get an RFE for EVL down the road, send the AC21 letter and the usual EVL .... make sure your new company will support you in such circumstances ...

Since you are working on EAD, benching shouldn't technically be an issue .... depending on ur case progress, you may get an RFE while on bench ... RFEs sometimes want details of current work (including client details) - so that might become an issue - only u'll know ur case status and expected approval/RFE dates and duration of the bench period.
Consider all of this before making the switch !
