I have a question on form I-130. Question #16 asks, "Has your relative ever been under immigration proceedings?" If someone has been refused entry to the US, i.e. allowed to withdraw application for admission, is the answer yes or no?
I read that as - if you say yes, it would have to be one of the four choices they gave you to check:
Removal
Exclusion/Deportation
Rescission
Judicial Proceedings
If you were able to formally withdraw the application - whether it was for admission or for permanent residency or whatever, then I don't think that is considered "immigration proceedings" - so I would answer no.
