I am Medical Physicist taking up a faculty position in an academic institution. I got hired based on an advertisement posted on the web exclusively for Medical physics community. My attorney suggests that if she applies for special handling category, then there should have been a paper advertisement posted in a journal.
She suggests that the employer withdraw my offer and redo it after posting an advertisement in a journal.
OR she suggests that the employer give a temporary position H1-B and then offer a permanent position after readvertising for the job in a journal.
question 1: Is it necessary for the advertisement to be placed in a journal for labor certification through PERM ??
question 2: What is the best solution, the first or the second...
