Myself and my husband has been in US since past 4 yrs and now we are willing to start our GC process and hence applying for LCA through PERM process. Both of us are working in H1B for the same company and we have been advised that anyone of us can apply for GC. Spouse will be included while filing I-485. My husband is applying for the LCA process under EB2 category. But, we have some query.
1. My continuous stay of 6 yrs will be over in Aug 2008. My husband is applying for GC and I will be included in the third stage i.e. I-485. Since, my 6 yrs will be over before filing I-485 and at that point there is no record that I am also applying for permanent residency, hence can I go for H1B extension in 2008 or will it cause any problem.
What shall we do in this scenario.
