I have a L1-B visa which is expiring (5 yrs) at the start of Sept 05. My employer has filed for an extension for the time I was not in the US during the last 5 yrs. They have also applied for an H1-B transfer. My LC was transferred from California to the Dallas backlog center (in federal labor since early 2004). The employer received the notification about proceeding from the backlog center and they have replied for continuation of the process. We are waiting on all the 3 processes above. The employer also has a pre-approved labor cert which exactly matches my qualifications. I have 2 questions
1. Should we just go ahead with using the pre-approved labor to avoid any complications about going out of status?
2. If yes, when my LC comes through, can the employer use it for some other employee with matching qualifications?
