I-485 pending
Have an EAD (renewed in June '03)
Entered US using AP on 8/17/03

My spouse
I-485 pending
Had an EAD(expired in June '03) but was not renewed since she never worked.
Will enter US using AP in Sep '03

Question ...
Does my spouse need an EAD even if she is not planning to work?
I may start a business in the next few weeks using my EAD. Does this make it mandatory for my spouse to apply for EAD renewal?
I have a kid who is also on I-485 (pending). What will be her status since I am no longer on H1?

Gurus...Please help.
 
1. Your spouse does not need an EAD if she does not plan on working.

2. If you want to open a company on your wife's name then its mandatory that she have an EAD.

3. Your child's status will be the same as yours and your wifes. You are all adjustment of status applicants. You are the primary, and the other are dependent.

Also, if you are planning to start a business using your EAD (whcih you said), your wife doesn't need EAD.

The reason for this question was because I read on another thread that you need to get an EAD for your spouse if you are no longer on H1.

He probably meant that they need EAD for working. Even if you are no longer on H1/H4, you are still in status as your 485 is pending.
