I had a bachelors degree + 4.5 yrs of work experience when I joined my company 5 years ago. They filed a GC RIR application for me in Feb 2003 under EB-3. Since then I have been promoted from a Developer to a Senior Developer role and have lots of additional responsibilities. I also got my masters degree (part time) couple of years ago. My Eb3 labor app and I-140 got approved, but I can't file I-1485 as CIS is still processing apps from apr 2001.
I requested the company lawyers to file for another labor app under EB-2 PERM so I can request I 485 using this new app. According to them as I did not have a masters degree or 5 years of work experience before i joined my present company, I'm not eligible to file under EB-2. Also I cant use my masters degree as my current company partly paid for the tuition expense. Is there any way to file a PERM app under EB-2? Could addtional responsibility warrant a EB-2 app?
