Hopefully the someone can help me here by giving their opinion(s). Here's the situation:
I want to invest in an LLC that is a partnership, that will be composed of several US resident people and several non-resident people under H1Bs (myself included). Incidentally, I am also a derivative beneficiary for my spouse's 485 application who is currently working under an EAD.
From what we understand, as long as the H1B partners are not employed by the LLC it is all legal in the immigration side of things. My questions are:
1) Is it certain that we (H1B partners) are not violating our immigration status in any way?
2) Since this will be an LLC partnership, and the profits/losses/taxes are passed onto the partners, I will have to declare or attach this to my personalt tax return. In the event that an RFE or an interview request is issued for the adjudication of my and my spous'es 485 applications comes up, will my being an LLC partner have a bearing on the adjudication?
