Pulling my hair out

Hi everyone, longtime reader and wondering if anyone could help me with a few questions?

I'm currently in the UK fretting whether i will get back into the US.

I got married two years ago and applied for adjustment of status along with AP and EAD, both were approved.

My AP ran out this year and I was still waiting for news from my application

I applied for AOS in Oct 2007 and had my interview in Feb 08 at the interview the I.O wrote "I-485 pending CR6" on my passport and told me I was approved but with conditions and should expect my card in 4-6 weeks, well its been 11 months and no card. I tried getting information for the last year but heard nothing!

I reapplied for my Advance Parole in Nov but left before it was approved as I had an infopass appointment and the officer told me it was possible to have it mailed although it was risky as it may get lost in the post or not be approved in time for my return.

I'm now waiting for that approval but after returning home I've been reading that many I may have abandoned my case for AOS and the AP may be denied, which would be a really BAD situation, however my wife spoke to an I.O that said if my passport has CR6 written in it by the officer I will be fine and that this means I do have conditional residency.

My flight back is in two weeks which may be enough time for the AP to arrive but its not a problem rebooking for a later date.

So did I screw the pooch? Does the CR6 in teh passport mean i was approved?

Will I have problems returning.

I'm kinda doing my nut in as we have a 15month old and just bought a new house which we planned to move into this month, and she kinda really needs me back in the US.

Cheers in advance:o

No. Pending CR6 was written, not an approval stamp.

Yes, until you can resolve your document problems. They may have already canceled your I-485 because you didn't return before it expired. If that is the case, you would then have to reapply via the US consulate in the UK, but you should be able to reuse the same I-130 instead of having to start from scratch.

Did you change your address after filing the I-485? If yes, maybe they sent the AP or the green card to the old address. Do you have the case number of your I-485, and did you check the status online?

BTW, you were given wrong information when told that you could leave the US and have the AP mailed to you. It needs to be approved before you leave the US.

Ok, so the Advance Parole has been approved and is on its way to me in the UK, I have booked to return Saturday week, so hopefully entry with it won't be too problematic.

Will keep updates:rolleyes:

Yes do update us: Since the AP was approved very recently, they may realize you were out of the country before it was approved. If they are aware of the rules (a big if), then they might give you trouble.

Sorry didn't reply earlier, been a hectic few weeks since I got back,

Ok so no problems coming in, went through the usual procedure with AP where the POE officer said It will need to be verified, went down to the other holding area and had my AP verified in minutes, in fact this was the fastest time i got through immigration :D.

Checked on the status of my I-485 and the IO said all is fine and its tsill in normal processing.

Phew! crisis averted
