Prudent to send some docs. while I am gone?!!!

Guys,

Need ur advice.

I am flying out 8/19-9/9 of USA. I am one of the unfortunate VSC Aug'01 filers (RD:8/9, ND:9/28, EAC-01-282) still waiting approval.

Will it be prudent on my part to send some of the documents in case there is an RFE from VSC while I am gone? I guess RFE info. is sent to the lawyer. I am thinking of following docs., please advise if any need to be added/removed (if at all):


1)Medicals for self and family
2)Marriage certificate
3)Copy of I-140 approval (done at TSC)
4)Employment Letter
5)W-2, 1040 and 1099-INT for two years
6)5-6 paystubs
7)Form I-9
8)I-94 records

What's the point?

If you hear about a RFE on the AVM even a few days before you leave it will still take 2-3 weeks for the letter to arrive to the attorneys office. The IIO will not inform you or the lawyer what the RFE is about so you have to wait until you get the letter to respond. Even if a IIO is kind enough to tell you what the RFE is about you still need the RFE letter with the RFE requested documents when submitting your response...

I guess dma_va is saying that he would send these documents to his lawyer so that in case there is an RFE, lawyer can respond back immediately even though dma_va might not be here.

Makes sense to me if thats the case. In addition you can also send copies of all pages in your passport ( if lawyer doesn't have that already).
 
Question?

If u are travelling to India in advance parole and you get an RFE or an Intend to deny will there be any problem during reentry in the US

That would be a very smart thing to do, in your absence if the lawyer gets the RFE and he has all documents handy, that will save you some valuable time.
 
Vivekm - Read my post again.

It takes 2 to 3 weeks for the RFE letter to arrive. You need the RFE letter with your other documents for the rebuttal. DMA_VA is out on vaction for 20 days. So, he should be back by the time the letter arrives.. that is if he gets a RFE.:p
 
Jibran, I see your point and I also see dma_va's point.

If I were in dma_va's situation I would be doing the same thing as he said.

Its a good idea to realize that every case is different and need not be same as yours. Some RFE letters arrive within a week or so, while in some cases it take 2-3 weeks and in some cases they never arrive and have to be requested again :)

Second I don't know the reason of dma_va trip back home , neither should I because it is private. But in case he is forced to extend his vacation by few weeks ( I have done that myself ), he will be losing all that time.

Anyway, I know what you are saying and what dma_va is saying also makes sense. Lets leave it to dma_va.

firstly let me apologise for jumping in on your conversation.

secondly Jibran am I missing something, where does dma_va say he is going for 20 days only, he may be going for a month or 2, your advise is right in case he comes back in 3 weeks, and vivekm is right if he prolongs, it would be a smart thing to do.

I do plan to go for 3 weeks only (God permit). I am still waiting for my lawyer's reply on the same question.

As for Krishnagc's query (What will you do if you hear on AVM on 08/18 evening that your case is approved?):

As I learned on this forum, if I don't have a letter in my hand till 8/19 (RFE/approval), I can fly out safely and when I come back at the POE, officer would know that I'm using AP and wasn't in a position to take action on VSC's reply (of 8/18). The officer should let me in USA and I can respond accordingly after that.


Isn't that right?

BTW, this was one of the reasons, I planned to fly out on Monday and not Friday etc.

On a lighter side: The compelling reason for leaving now: I couldn't anymore hold on to spouse dear's curses of not going earlier (missing her sister's wedding and hell lot of other things)
