Promotion while on 6+ yr H1 (and Green Card being processed)

Folks,
Does anyone know if one can be promoted while on 6+yr H1 and GC is being processed for the CURRENT job position? The position would change materially e.g. from Analyst level to Manager level.

I have heard GC is for future position, and therefore technically you don't have to be in that job position when you are granted the green card. However, I have also heard that INS (or its current avatar) asks for some kind of proof of position. Any idea how this works?


Also, if promoted would one to have change the Job Title and Description in
a) H-1B extension application
b) Labor application
c) I-140/I-485

The promotion may affect your H-1B but rather GC, as long as you will take that LC job at the time of your I485 approved. You can file an H-1B amendment. In practice, however, some people just do nothing until next time extension.
 
Thanks Compiler.Do you know how the USCIS actually verifies that you are in the position (during or after the I-485 stage)? What kind of documents do they require for proof?
 
The employer’s letter to confirm the job title, duties, salary etc (but unlikely to your H-1B). So, tell the employer just provide the same job info as listed on the LC in case the USCIS requested. As for after the I485, you really do not need to worry about it.
