Hi
Does anybody have any clue or pointer where I can get reibale information on the promtions during immigration process.

Specific question is prmotion allowed in same category i.e. juinour sw programmar -> senior software programmar etc. is allowed during the immigration process.

I knowfor sure that the changeover from programmar is not possible as it changes your duties.

Still your info will be useful.

Thanks

Promotion within the same occupation should be fine, i.e. from Junior Programmer to Programmer. As long as your employer is able to give you employment letter (in case of RFE) with job duties similar to your LC and salary at or above your LC salary level you should be OK.

Linear growth comensurate with your experience and educational qualifications are allowed as far as the two jobs descriptions are same or similar in nature, and the salary is equal or higher than LC salary.

Check www.murthy.com in the FAQ's for law citations. I remember searching there for a different post.

Are you sure it is greater than and not less than the salary mentionedin the LC

I tried locating,but in vain.

Please ( please rest to N where N tends to infinity ) locate it for me and let me know.

Thanks

Don't not be so sure!

I have asked my layer before. Her answer was "small increase salary is OK, promotion/big increase may cause issues on LC. Let me check the document before your employer acts on it".

My understanding is it may beyond your range of your LC.

So do check with your layer first.

My Experience

I talked to my attorney one year back on the same issue. They advised me not to take the promotion, if the new position has supervisory requirements on the current position.
Satya:rolleyes:
