Processing time for DOL in SFO

Hi,

My case was filed in Sept 2001 in RIR category. It cleared the EDD state in Sept 2002. Then because of the bad market from the DOL it got pushed back to EDD again and got moved to non RIR.

Recently because of Carlson's law it again got moved back to DOL and back to RIR on Dec 16 2003

I have a few questions

1)What is the date they will consider to process my case in the DOL Sept 2002 or Dec 2003.
2) has any one else experience this? Have your case been cleared from the DOL?
3)Is there going to be any improvement in the LC processing times?
4)What is the timeframe in which all of u are recieving your labor application processed.

Any help will be greatly appreciated

DOL is currently looking at all the "returned" applications.. so your previous priority date is being considered, but they are processing application as they receive it from EDD (DOL seems to have stopped processing the application actually received in Dec2002 - but are working on the cases "returned" from EDD on Dec2003). Check the following thread to guage the current trend

The processing times have actually halted to reconsider the previous applications, since they are processing the "returned" applications first, you should have your case results soon.

Most of us are waiting about 2+ years before we hear back from the DOL.

wondering if you could help me with some of the answers below

My case was applied with the BS + 2yrs experience. As I understand the Carlson's memo requires BS+3 yrs exp.

Has anyone heard of cases with BS+ 2 yrs exp getting cleared?


Also if one's case goes into the appeal state - how long does it take for the appeal to get approved?

And if the case is pending in appeal state can we extend H1b?

Any help will be greatly appreciated.
