I am in Kinda a strange position. I am working with a bankrupt company. My Application was filed for Labour Certification in Nov 2001. Just now I received a comunication from my lawyer that they have received Notice of Findings from INS, which essentially asks, (i) if any layoffs happened in my company in last 6 months, (ii) if any laid off worker is given consideration for my position, and (iii) DOL wants to run an additional ad.
I am not sure if running an additional ad for a bankrupt company is possible or not. I am completing my 6 yrs in Apr 04, I am already out of 6 yr limit, I guess since my Labour Appln is more than 365 days old.
I want all of yours halp to find out my options. What will happen if my company is unable to run an ad, and I have to file in regular processing (currently its filed under RIR). Where do I stand if it starts in Regular processing. Any other options that I am overlooking ??? Please Help me with your thoughts and suggestions....I need them badly....
