Process Time I-130

Hello,

I live in Texas and am a US citizen. I recently got married to a Singapore Citizen. I am going to file an I-130 so she can live in the states. Can someone please let me know how long it might take to get the I-130 approved (I am assuming she'll have to go for an interview in Singapore once its approved).

Also, the CIS stated that if I do I-129F or K-3 application and it is processed while the I-130 is still pending I will have to file a 485 change of status. Do you think I-130 will take longer than than I-129F/K3? Keep in mind I am in Texas.

Is your fiance in the US now? If she is, make sure she doesnt over stay her visa- if she does, when she returns to Singapore for K3 interview then she could acrue a ban (3 or 10 years depending on length of over stay).

Just a little food for thought- if you file the I-130 without the I-129F then you go down the CR1 (or it could be IR1- I get confused over which one is which). Its the I-129F which triggers the K3. The benefit of not filing the I-129F and therefore going the CR1/IR1 route is:
1) It takes roughly the same time frame to recieve
2) Your wife will enter the States (after her interview) as a permanent resident.
3) You do not have to file adjustment of status
4) You do not have to pay the $1010 for adjustment of status
5) You recieve your greencard 1-3 months after entry to the states (compared to roughly 1 year when adjusting statues via K3).
6) Your wife is work authorised upon entry to the states (you dont have to file for EAD and wait approx 4 months to recieve this document).
