Process Question for Las Vegas filers

We filed our N-400 late June and got the letter for our interview about 2 weeks ago. It is scheduled for March 19th. YEAH!!!!

My wife would really like to go back to Thailand due to some family issues, but I am not sure what will be required after her interview.

I did some research and it looks like she will get a letter asking her to come back for the oath about 4-6 weeks after the interview. Does that sound right?

After the oath, I am assuming we do not have to be in the USA. I am also GUESSING that we can file for her US passport while in Thailand. Is that possible?

I would sure appreciate any help you all could provide. We are almost there!

Thanks!

Craig,

whilst having a passport is the final step, the citizen ceritficate is what counts.
I am sure you can apply for a passport abroad - after all, you could have lost it or it got stolen - a matter of imagination.

Remember - she has her Thai passport, thus travel isn't an issue. Admission back in is and for that the ceritificate should be good enough.

Still, I would wait the few weeks to get it all done and over with.

Actually, they can track to see if you have ever had a U.S. Passport issued. So imagination will not help you if you lie. Also, once a person naturalizes they must leave and enter with a U.S. passport. USA does not recognize dual citizenship - although they don't deny it - they also do not acknowledge it. Therefore if you become a U.S. citizen - you are expected to use a U.S. passport for travel at all times. One cannot use the certificate of citizenship to enter back into the USA except for land/border entries - and that is until June 2009. So she will not be able to use her certificate.

If your wife intends on leaving right after the oath, she can get a passport issued in 1 day through a regional passport office if you all can prove you have a trip in 2 weeks or less. You must show proof of travel and you will be able to pick up her passport that same afternoon. Go to travel.state.gov for more information regarding this.

More importantly, a person is treated like a PR until they take their oath. So in between the interview and oath, the same rules apply in regards to physical and continuous residence. You must be careful about how long you stay out and must maintain ties with the U.S.

*cough*

We don't lie and not even imply that ever.

Fact is that if you LEAVE the US, no one cares. Getting back is the issue and I agree, best is to do everything to the book 110% and then some.

I was able to enter the US w/o my GC - granted it was a hassle, but it was possible w/o a long hold up. Keep in mind, not everything is that tight. Luckily there are still humans involved in the process. Not everything is done by the letter and they do have some options at immigration.

In my case I came back from Cancun and for the life of me couldn't find my GC. Found it eventually - at home. Though it was only a short trip of 4 days.

Sorry for the late response. I have not had good internet access for the past few weeks. Looks like we will be OK and should have no problems getting a passport...whether here in the US or in Thailand.

This dual citizenship is a bit tricky. Her Thai passport is great for Asia...avoiding visa fees in many countries...but like you said, she needs her US passport for coming back here...and for the many countries that are difficult for her to travel to with a Thai passport...such fun...

Thanks!!!!!
