I appreciate your help.
I filed I-140 at CSC in Aug-2003. The lawyer offered to file under two categories, namely EB-1 and NIW. He offered to file concurrently too. After a long break of almost a year, last week I called him to check the status of the case, and he mentioned that he filed for just EB-1, not NIW. I was really upset and I did not ask him about I-485. I hope he filed it.
My questions are:
Can I insist on filing under NIW also at this later stage?
Can I stiil file I-485 if he did not file it earlier?
What are my options at this late stage of the filing.
