Problems using Advance Parole visiting India- Need help

Hi,

I am planning to visit India and planning to use Andvance Parole

Let me tell my Background I came to US on H4 and got Hi transfer

its been 3 Yrs i have been on H1 but my passport is no reflecting
H1 and my H4 expired 2 Yrs back.

Given the situation I am legally on status with the present H1 valid till 2005.

If i use AP will i come across any problems with my passport reflecting expired H4 at the port of entry when i come back to US.

and what docs should i carry along with me when i travel to India

anybody has any experiences with using AP please help me.
As i have to attend my father Death Cermony.

When travelling on AP, you don't need any additional documents for entry. Expiry of visa does not imply being "out of status". Status is deemed by duration of H1/4 approval notice and AOS application.

If you have never been out of status in your stay within the US, you only need your valid passport and Valid AP to enter the country.
 
Important is your I-94 not stamping. If your I-94 expiry date is the date before I-485 Mailing date then you ware out of status. Please provide the dates for clear understanding. Without that all answers are just guess.

My I-94 is valid till 2005 November which is mentioned on
my Hi papers i have recieved.

As regards to 1 485 filing is concerned the I-140 and I-485 where
filed 6 months back i.e on june 2003 .
we have recieved EAD and AP in the month of july.


Keeping in view of this info , I was never out of status.

First time when i was on H4 -which was valid till oct 2002.

But I got my first H1 on X company which was valid from december 2001 till 2004.

Next H1 transfer was done in 2002 and i got H1 extension till 2005.

I am benificiery of Green card thorugh my wife as a dependent.

IN view of this situation please advise me if i can use AP and hope there wouldnt be any problems.
