Problem with visa for spouse after filing 485?

Hi,

I filed my 485 a month back. I\'ll be bringing my
spouse after we get married in Jan from India, on
a H4 visa.

I hava valid H1 visa. Would my filing of 485 cause
a problem in obtaining an H4 for my wife?

Till the time you are working on H1 and not using your EAD, you are fine.
Once you use your EAD, your wife cannot apply for an H4.

How would I start \'using\' an EAD?

I have a valid H1 until Feb 2003. Meanwhile if I get my
EAD in December does it mean I automatically start using
an EAD? How can I stay on an H1 so my wife would get an H4?

Hi CD,
    No. To work in EAD, You will have to file I-9 form. As long as you do not file it and your H1 is valid, your wife can come and stay in H4. Before start using EAD, bring your in H4 and immediately file I-485 for her.
