Problem with sex gender on my mom's green card.

Hello Guys!

I am finally back from Peru, I traveled with both of my parents after they received their green card. The only problem that we noticed after entering the states is the gender on my mom's green card. Instead of "Female" it says "Male". The immigration officer told me that this is not a real big issue but we should file I-90 to correct her green card.

On Oct 1, 2013 we sent the I-90 along with a cover letter explaining the problem and her birth certificate. The only problem right now is that my mom is planning another trip to Lima, Peru on Dec 9 2013 and I am not sure if by then she will be able to get her fingerprint so we can make an infopass and stamp her passport.

What do you guys think? Should I book a flight for her? or wait for her passport stamp first? The only thing is if I wait too long to book a flight it will be way to expensive by then :(
 
Fingerprinting is usually within 2-5 weeks after USCIS receives the application. She'll definitely be fingerprinted before December unless something goes very wrong like the appointment notice getting lost in the mail.

Do you think it should be safe to book a flight to Lima now? or wait for her fingerprint? The only thing if we wait is that perhaps the tickets will be really expensive by then :(.
 
Book it now. She'll probably be fingerprinted this month.

I followed your suggestion and I booked my mom a flight to Lima for this December 9, 2013.

Today I tracked my mom's I-90 that I sent on Oct 1 in order to have her GC replaced and the website shows that her package was received on Friday, Oct 4, 2013 and until now we haven't received any letter from them, do you think it is still kind of soon?

I am asking this because my mom is kind of worry right now and she is asking me:

1: What could happen in the worse case scenario that USCIS will take a little longer and she won't be getting her fingerprint on time?

2: Can she still travel to Lima and when it is time to come back can she go to a US Embassy in Peru with a copy of her GC and get a travel document?

3: What could happen if for some reason her fingerprint appointment comes when she is already in Peru? Can she reschedule it?

I will really appreciate your prompt response.

1. If she has an I-551 stamp in her passport (which should be there if she interviewed for the GC in her country) and it will be valid through her trip in December, she can use that to travel. If she doesn't have that, but gets the I-90 receipt, the receipt can be used to obtain an I-551 stamp at an Infopass appointment.

2. If she doesn't have and can't get the I-551 stamp, she can apply for a Transportation Letter through the embassy.

3. Yes, it can be rescheduled.

1: She does not have I-551 stamp because she never had an interview and I petitioned for her while she was here illegally (but entered the country legally).

My mom is the type of moms who worries too much for everything and I already told her that she is already a permanent resident and that shes does not have to worry about getting out of the country even if she can't get a I-551 stamp on her passport on time. I tried to explain to her about the Transportation Letter that she could get in Peru but she keep saying that she needs her green card or the I-551 stamp in order to travel!! ... Upps!

It is still kind of early to wait for the I-90 receipt correct? and do you think is good enough with the I-90 receipt to make an infopass appointment and get her passport stamp? I thought she needs to get her fingerprint done before she can get her passport stamp and travel.

Yes, she can get the passport stamp with the I-90 receipt. It's not necessary to wait for fingerprinting, but most people prefer to get it done at the fingerprinting appointment so they don't need to make two separate visits to USCIS.
